Defenders of the Year 2022
Recognition and Celebration of Extraordinary Human Rights Defenders

The Safety and Risk Mitigation Organization (SRMO) is marking this year’s Human Rights
Day and 10
th Years of anniversary by celebrating six extraordinary individuals and entities
who have shown the utmost dedication to protecting Human Rights Defenders (HRDs)
during 2022.
“Without the dedication and hard work of those who are being recognized by SRMO as the
Defenders of the Year 2022, our work to protect the most at risk HRDs would not have been
possible. Many Afghans owe their lives to these people” said Horia Mosadiq, founder of
SRMO.

SRMO is honoured and privileged to announce the Defender of Year 2022 finalists as
follows:

1- Samira Hamidi, South Asia Campaigner at Amnesty International and a Human Rights
Defender from Afghanistan.
 2- Benny Agus Prima, Human Rights Defenders Programme Manager at Asian Forum for
Human Rights and Development (Forum-Asia)
3- Deanne Uyangoda, South Asia Protection Coordinator Frontline Defenders
4- Heather Barr, Associate Women Rights Director Human Rights Watch
 5- White Scarves (a group of dedicated women who evacuated more than 1500 mostly
women leaders, women rights and human rights activists)
6- Zahra Joya, Editor in Chief of Rukhshana Media

Between them, these people supported the evacuation and protection of hundreds of HRDs,
Women Human Rights Defenders (WHRDs), Civil Society Activists (CSAs), journalists, women
politicians, and women legal professionals. Others on the list continued to tirelessly
campaign for women’s rights and human rights despite the immense challenges. The award
symbolizes their selflessness, dedication and exceptional contributions to protecting the
most at risk Afghans.

Background:

The Taliban’s return to power in August 2021 was not only a major setback to the Afghan
people’s achievements of the past 20 years, but also posed serious threats to those who had
worked for the promotion of human rights and democratic values post 2001.
Thousands of Afghans at high risk of retaliation from the de facto authorities have been
evacuated since August 2021 and resettled in various host countries. However, there are
still hundreds of at risk HRDs, WHRDs, journalists and women protesters and their families
who are living a life of fear and uncertainty, both inside Afghanistan and in neighboring
countries.

Afghan Human Rights Defenders are at risk more than any other time:

Today Safety and Risk Mitigation Organization (SRMO) is launching its2021 l annual report on the state of Human Rights Defenders in Afghanistan.

Over the course of the year 2021, a total of 37 activists, media workers and their family members were killed in targeted attacks. A further 5 were targeted in failed assassination attempts. Of those targeted, 13 were women and 29 were men. Those killed included 18 civil society activists, three family members of civil society activists, 6 women human rights defenders, the son of a human rights defender, and nine media workers. The true number of attacks against members of the Afghan civil society could be much higher than it is reported by the media or family members.

The 37 killings and dozens of other incidents discussed in this report represent only a selection of the true number of cases. Based on its systematic monitoring of the situation on the ground and regular communication with HRDs/WHRDs, SRMO believes that the actual number of attacks and threats against HRDs, WHRDs, CSAs and other at-risk groups is much higher. SRMO observed that there is a low self-care awareness and reporting by HRDs and CSAs of threatening incidents, especially among WHRDs and civil society in the provinces.

The vast majority of targeted killings involved shootings, with smaller numbers of cases involving improvised explosive devices (IEDs); at least four targeted killings in Kabul involved the use of magnetic IEDs or ‘sticky bombs’ attached to the victims’ cars. This type of attack often causes additional casualties including drivers, other passengers, and bystanders.

“The Taliban have completely closed any space for dissent. They have launched a campaign to persecute and silence critical voices, particularly women, who have continued to publicly voice concerns and protest against their rights being taken away by the new regime. Women protesters were abducted, arbitrarily detained and tortured for peacefully protesting and demanding their rights.” Said Horia Mosadiq, Founder of SRMO.

While SRMO’s core focus is on HRDs, Women Human Rights Defenders (WHRDs), and Civil Society Activists (CSAs), we also hear through our networks of multiple attacks on other parts of civil society and civilians in general such as media workers, legal professionals, university lecturers, religious scholars and others. We have included data on attacks on these other affected groups in this report because they are illustrative of the broader human rights environment in the country and because many of these incidents are not being reported elsewhere. These cases illustrate the dramatic shrinking of the civic space in the lead up to and since the Taliban takeover in August 2021, and the danger that HRDs, CSOs and others face when they try to exercise their fundamental rights of freedom of assembly and freedom of expression. These rights were guaranteed by the Afghan constitution, which has been suspended by the Taliban de-facto government. Moreover, the fact that many journalists have fled, gone into hiding and/or are self-censoring means that much less news reporting is available than was the case prior to the Taliban takeover, making it useful to share these cases here.

Background:

The Safety and Risk Mitigation Organization (SRMO) is an Afghan-led NGO. It was established in May 2013 to provide protection to grassroots Human Rights Defenders (HRDs) at risk in Afghanistan. SRMO’s main objective is to develop and provide local protection solutions to HRDs in Afghanistan and to empower HRDs so they can safely continue their crucial work. Since the Taliban takeover of Afghanistan in August 2021 SRMO has continued to provide support both to HRDs inside the country and to those who have fled and are now living in exile. The organization is in the process of recalibrating its operations to ensure that it can continue its mission, despite the immense challenges presented by recent developments.

SRMO was established to respond to the growing threats and attacks against HRDs and Women Human Rights Defenders (WHRDs) in Afghanistan and the lack of an effective mechanism to provide them with protection. SRMO provides capacity building (including safety and risk mitigation training, first aid training and stress management), facilitates and provides emergency grants, legal aid, emergency relocation, emergency housing, safety and risk mitigation advisory, site security surveys for accommodations and offices of HRDs and WHRDs, and training for unarmed security guards and for drivers supporting HRDs. SRMO has particularly focused its assistance on local and grassroots’ HRDs and WHRDs, recognizing their utmost vulnerability as being at the frontline of defending human rights. SRMO focuses its resources on helping HRDS and WHRDs operating in insecure and rural areas where activists have very limited or no links and contacts with international organizations or diplomatic and UN missions for protection.

 Press Release:  Afghan government should put urgent measures to protect Human Rights Defenders and Civil Society Activists facing increased deadly violence.

 

  • The International community should not leave Afghan HRDs unsupported.
  • Taliban must immediately cease attacks and threats against HRDs.

Today the Safety and Risk Mitigation Organization (SRMO) is publishing its annual report on the State of Human Rights Defenders in Afghanistan for year 2020. The organization is appalled to report that the year 2020 was the deadliest for the Afghan Human Rights Defenders (HRDs) and Civil Society since SRMO started documenting cases of attacks and threats against HRDs and civil society activists (CSAs) in 2015. We are even more worried to see the same trend continuing through the 2021, as the Afghan government fails to provide urgent protection for HRDs. This is spreading fear among the HRDs community across Afghanistan while civil society put all efforts to mobilize and ensure human rights and freedoms are protected in the possible peace deal with the Taliban.

SRMO is alarmed by the increase of targeted attacks on the civil society and HRDs in Afghanistan that especially swelled since the start of the peace negotiations in 2020. This is an extremely worrying trend that must be stopped. It makes the job of civil society to defend victims of violence and human rights violations and to protect human rights ever more challenging as their lives are endangered.”, said Horia Mosadiq, a women’s rights and justice defender and SRMO’s Founder.

For the period between January and December 2020, SRMO documented a total of 55 cases of violence and abuse against HRDs and civil society activists, comprising of 39 male activists and 16 female activist victims. Out of these, 19 HRDs and CSAs including two of their family members were killed, mainly as a result of targeted attacks against them. This is a five-fold increase of HRDs’ deliberate killings comparing to 2019 and 2018 when SRMO recorded four killings of HRDs in each year. Among the CSOs who were deliberately killed in 2020, there were three WHRDs, peace activists and two AIHRC staff.

The Taliban were implicated in 18 cases of attack against HRDs, related to threats, kidnapping and two deliberate killings and an assassination attempt of CSAs. For 25 of the cases of threats, intimidation and majority (16) of the targeted killings against HRDs and CSAs no one admitted responsibility until now. In addition, SRMO recorded at least nine cases of human rights abuses against civil society and HRDs by Afghan authorities through arbitrary arrests, intimidation and judicial harassment, which were in connection to civil society members legitimate activities and their right to freedom of expression and assembly.

We are seeing a new worrying trend that has emerged in 2020, where there has been NO admission of responsibility for a wave of targeted attacks and killings of HRDs. However, this should not be used as an excuse by the Afghan Government not to investigate such cases.”, said Horia Mosadiq, founder of SRMO.

Another disturbing pattern, revealing the abusive environment in which civil society is operating amidst the peace process, is that the spikes of attacks against civil society coincided with the peace negotiations phases. Since the commencement of the peace negotiation between the Afghan Government and Taliban in September 2020, SRMO documented nine cases of targeted killings of activist for the period October-December (five killings of HRDs occurred in December). SRMO data also revealed patterns of significant increase of threats and attacks against HRDs and CSOs around the peace negotiations, in February (as the US-Taliban concluded their peace negotiations) and in August (prior the start of the intra-Afghan peace talks in September), majority attributed to the Taliban.

Women human rights defenders continued to operate in highly threatening environment, as majority of the cases of WHRDs documented by SRMO experienced threats, including by the Taliban. WHRDs continued to be targeted for who they are and the values they stand for, often being accused of “spreading anti-Islamic values”.

At the time when attacks against HRDs, WHRDs and members of CSOs are at their highest, the Afghan government is failing to investigate and bring the perpetrators to justice while it is shifting the blame to the Taliban and the Haqqani Network. By doing this, the government is withholding its responsibility of protecting the Afghan citizens including HRDs, WHRDs, journalists and members of CSOs.”, said Horia Mosadiq

SRMO welcomes the establishment by the government of the HRDs National Protection Strategy launched in January 2020, in response to the persistent calls for protection by the Afghan civil society, and the setting up of the Joint Commission on protection of HRDs in December 2020. However, nothing has changed so far in practice for the protection and safety of HRDs. SRMO reminds the Afghan Government, that the primary responsibly lies with the state to protect the right to life of its citizens and promptly investigate and provide remedy to the victims of human rights violations, as well as to respect and protect the right to freedom of expression and peaceful assembly and association.

  • SRMO calls on the Afghan Government to step up efforts to protect Human Rights Defenders, investigate and bring the perpetrators of threats and deliberate attacks against HRDs and civil society to justice, regardless of whether the perpetrators are state or non-state actors.
  • SRMO urges the Taliban to immediately stop all attacks and issuing threats against human rights defenders, women human rights defenders, civil society, aid workers, and media and respect their legitimate human rights work and freedom of expression.
  • SRMO reminds the international community of their responsibility and promises of protecting human rights in Afghanistan and urges them to publicly condemn attacks against Afghan HRDs in strongest terms and support the Afghan authorities in implementing the HRD protection mechanism. Donors should allocate adequate financial resources for Afghan NGOs who are working for the protection of HRDs, so that they can continue providing their vital services for HRDs and civil society at risk.

اعلامیه مطبوعاتی: دولت افغانستان  باید تدابیری رویدست گیرد تا از مدافعان حقوق بشر و فعالان مدنی در قبال حملات مرگبار که به ان روبرو هستند، محفاظت نماید.

 جامعه بین المللی نباید افغانستان را بدون حمایت ترک کنند.

 طالبان هر چه عاجل باید حملات و تهدیدات شانرا علیه مدافعان حقوق بشر و فعالان جامعه مدنی توقف بدهند.

امروز نهاد مصئونیت و کاهش بحران (SRMO) راپور سالانه خود را در رابطه به وضعیت مدافعان حقوق بشر و فعالان جامعه مدنی در سال 2020 در افغانستان به نشر میرساند. موسسه مصئونیت و کاهش بحران  با تاسف گزارش میدهد که از سال 2015 بدینطرف که حادثات حمله و تهدیدات علیه مدافعان حقوق بشر و فعالان جامعه مدنی را ثبت مینماید، سال 2020 یکی از مرگبارترین سال ها برای مدافعان حقوق بشر و فعالان جامعه مدنی بود. قسمیکه دولت افغانستان در حفاظت از مدافعان حقوق بشر و فعالان جامعه مدنی ناکام مانده است، ما نگران این هستیم که این روند در سال 2021 نیز ادامه پیدا خواهد کرد. این اوضاع ترس و هراس را در میان مدافعان حقوق بشردر سراسر افغانستان ایجاد نموده است، و در حالیکه جامعه مدنی افغانستان تلاش دارد تا در مذاکرات صلح با طالبان اساسات حقوق بشر و آزادی های فردی  را حفظ نمایند.

نهاد SRMO نگران تشدید حملات هدفمندانه بالای فعالان جامعه مدنی و مدافعان حقوق بشر در افغانستان میباشد، بخصوص این حملات از زمان آغاز مذاکرات صلح در سال 2020 بیشتر گریده است. این یک روند بسیار نگران کننده است که باید هرچه عاجل توقف یابد. حوریه مصدق  یکی از مدافعان حقوق بشر و بنیان گذار نهاد (SRMO) اظهار مینماید که، ” چنین وضعیت کار جامعه مدنی را در عرصه دفاع از قربانیان خشونت و تخلفات حقوق بشری و حفاظت از ارزش های حقوق بشری به چالش میکشاند و زندگی آنها را به خطر مواجه میسازد.”

نهاد SRMO از جنوری تا دسامبر سال 2020، به تعداد 55 قضیه خشونت و تخلف علیه مدافعان حقوق بشر و فعالان جامعه مدنی را ثبت نموده که شامل 39 فعال مرد و 16 فعال زن که قربانی این حادثات بودند، میباشد. در اثر حملات هدفمندانه علیه مدافعان و فعالان جامعه مدنی  19 مدافع و فعال مدنی بمشول 2 تن از اعضای فامیل های شان کشته شدند. این آماردر مقایسه با گزراشاتی که دفتر SRMO در سالهای 2018 و 2019 ثبت نمود است، افزایش پنج برابری را نشان میدهد. درحملات مرگبار سال های ۲۰۱۸ و ۲۰۱۹  چهار مدافع و فعال مدنی درهر یک از این دو سال کشته شدند. در میان کشته شدگان در سال 2020، سه تن آنها فعالین صلح و دو تن آنها کارمندان کمیسیون مستقل حقوق بشر افغانستان بودند.

طالبان در 18 قضیه حمله علیه مدافعان حقوق بشر و فعالان جامعه مدنی که شامل حمله، تهدید، اختطاف و دو قضیه کشتار عمدی و یک سؤقصد علیه مدافعان مظنون شناخته شده اند و در 25 قضیه دیگر که شمال تهدید و ارعاب و 16 قضیه قتل های هدفمندانه علیه مدافعان حقوق بشر و فعالان جامعه مدنی میباشد که تا بحال هیچکس مسوولیت انرا بدوش نگرفته است. علاوه بر این، موسسه SRMO نه قضیه دیگر را ثبت نموده که در آن مدافعان حقوق بشر و فعالان جامعه مدنی توسط مقامات دولتی خودسرانه توقیف، تهدید، تهدید به دستگیری وتوقیف قرار گرفته اند که بیشتر آنها بخاطر فعالیت های قانونی مدنی شان و بخاطر آزادی بیان و تجمعات  مسالمت آمیز شان بوده اند.

حوریه مصدق بنیانگذار نهاد SRMO میگوید که، ” ما شاهد یک روند نگران کننده هستیم که در سال 2020 بوجود امده که هیچکس تا بحال مسؤلیت موجی از قتل های هدفمند را که علیه مدافعان حقوق بشر و فعالان جامعه مدنی را بدوش نگرفته است و این موضوع نباید باعث آن گردد تا دولت افغانستان چنین قضایا را مورد تحقیق قرار ندهد.”

 آنچه مایه نگرانی است اینکه، جامعه مدنی درحالیکه پروسه صلح جریان دارد همچنان با خطرات مضاعف برای پیشبرد فعالیت هایشان روبرو استند وهمزمان با مراحل مذاکرات صلح، حملات هدفمند بر علیه مدافعین حقوق بشر نیز افزایش یافته است. از زمان آغاز مذاکرات صلح میان دولت افغانستان و طالبان در ماه سپتمبر 2020، SRMO حدودآ نه قضیه قتل های هدفمند راعلیه مدافعان حقوق بشر و فعالان جامعه مدنی را در میان ماه های اکتوبر و دسامبر ثبت نموده است که  تنها پنج قتل هدفمند در ماه دسامبر صورت گرفت. همچنان اسناد SRMO نشان میدهد که روند حملات علیه مدافعان و فعالان جامعه مدنی در جریان مذاکرات صلح افزایش یافته است، و بیشتر حملات که صورت گرفته  بخصوص در ماه فبروری ( زمانیکه توافقنامه صلح میان طالبان و امریکا امضا شد)، و در ماه اگست پیش از آغاز مذاکرات صلح میان دولت افغانستان و طالبان، به گروه طالبان نسبت داده میشود.

زنان مدافع حقوق بشر در یک محیط پر از مخاطره به فعالیت های شان ادامه میدهند، و اکثر قضیایا ایکه  SRMO ثبت نموده است نشان میدهد که زنان مدافع حقوق بشر تهدیدات زیادی را تجربه میکنند به شمول تهدید توسط طالبان. زنان مدافع حقوق بشر به صورت پیهم بخاطر ارزشهای که آنها به آن باور دارند و بخاطر زن بودنشان،  توسط طالبان متهم به گسترش دادن ارزشهای غیر اسلامی میگردند.”

حوریه مصدق گفت، ” در حالیکه حملایت علیه مدافعان حقوق بشر و فعالان جامعه مدنی به اوج خود رسیده، دولت افغانستان در عرصه تحقیق و به محکمه کشاندن مرتکبین این حملات ناکام مانده است، و دولت افغانستان، طالبان و شبکه حقانی را مسؤل چنین حملات میدانند. با متهم نمودن این گروهها، دولت افغانستان از مسؤلیتی که در قبال حفاظت از مدافعان حقوق بشر و فعالان جامعه مدنی و خبرنگاران دارد،  شانه خالی میکند.”

SRMO از تصمیم حکومت بخاطر تاسیس استراتیژی ملی حفاظت از مدافعان حقوق بشرکه در جنوری سال 2020 احیا شد پشتیبانی میکند. این تصمیم در پاسخگویی به تقاضا های مکرر جامعه مدنی مبنی بر تحفظ ، حکومت یک کمیسیون مشترک را برای حفاظت از مدافعان حقوق بشر در ماه دسامبر 2020 ایجاد نمود. باوجود این، در عمل هیچگونه تغییری بخاطر حفاظت از مدافعان حقوق بشر صورت نگرفت. SRMO یک بار دیگر به حکومت افغانستان یاد آوری میکند که حفاظت از مدافعان حقوق بشر و فعالا ن جامعه مدنی و تمام شهروندان یکی از مسؤلیت های اساسی دولت است.  حکومت باید هرچه عاجل تخلفات حقوق بشری را مورد تحقیق قرار داده و راهکارهایی را برای  قربانیان خشونت حقوق بشری، و همچنان احترام و حفاظت از حق آزادی بیان و اجتماعات مسالمت آمیز، رویدست گیرید.

  • SRMO از حکومت افغانستان میخواهد تا تلاشهای خود را بخاطر حفاظت از مدافعان حقوق بشر تجدید نماید و قضیه خشونت علیه آنها را تحقیق و مرتکبین تهدید و حملات عمدی علیه مدافعان و فعالان مدنی را صرف نظر از اینکه مرتکبین افراد دولتی باشند و یا غیر دولتی به محکمه بکشاند.
  • SRMO از طالبان میخواهد تا هرچه عاجل تمام حملات شانرا و پخش تهدیدات علیه مدافعان حقوق بشر و فعالان جامعه مدنی، کارمندان موسسات خیریه و کارمندان مطبوعات را توقف بدهند، و به فعالیت های قانونی حقوق بشری آنها و آزادی بیان احترام قایل شوند.
  • SRMO از جامعه بین المللی تقاضا مینماید تا مسؤولیت شانرا در قبال وعده یی که بخاطر حفاظت از حقوق بشر در افغانستان داده اند، ادا نمایند و تاکید میکند که حملات بالای مدافعان حقوق بشر و فعالان جامعه مدنی را به شدید ترین الفاظ محکوم نمایند، و دولت افغانستان را در تطبیق میکانیزم حفاظت از مدافعان حقوق بشر حمایت نمایند. حمایت کنندگان مالی باید منابع پولی بیشتر را برای موسساتی که در عرصه حفاظت از مدافعان حقوق بشر کار میکنند، تخصیص دهند تا انها به خدمات حیاتی شان  به مدافعان  حقوق بشر و فعالان جامعه مدنی که در خطر قرار دارند، ادامه بدهند.

 Safety and Risk Mitigation Organization (SRMO): The government of Afghanistan must do everything to bring the perpetrators of attacks against Human Rights Defenders and Civil Society Activists to justice.

Safety and Risk Mitigation Organization (SRMO) strongly condemns the assassinations of Mr. Yusuf Rashid Executive Director of Free and Fair Elections Foundation of Afghanistan (FEFA) in Kabul and Freshta Kohistani a Women Rights Defender from Kapisa province.

The year 2020, saw a significant increase in targeted attacks against Afghan HRDs, WHRDs and members of civil society in Afghanistan and 12 members of the Afghanistan civil society including Human Rights and Women Rights Defenders are mostly killed in targeted attacks.

Mr. Yusuf Rashid, was targeted and killed along with his driver by unidentified gunmen in Kabul on 23rd December while he was going towards his office, no one took the responsibility for his killing yet. Taliban denied any involvement in killing of Mr. Rashid and said that they are not targeting civilians.

Ms. Freshta Kohistani, who was a known Women Rights Defender and head of Women Movement of Kapisa was killed along with her youngest brother in Hesa awal-e- Kapisa on 24th December by unidentified gunmen while she was returning from a field visit.

Ms. Kohistani around 10 days before in a Facebook post claimed that she was under serious threat and she reported those threats to the Ministry of Interior and National Security Directorate (NDS) but they have not done anything to investigate the threats or to provide her any protection. She called on the first Vice- President to do something about her security threats and provide her protection.

The government of Afghanistan launched the HRDs Protection Strategy in January 2020, the government has failed to investigate the attacks against members of the civil society including HRDs and WHRDs and so far no investigation was conducted and no perpetrator was brought to justice in relation to these attacks.

SRMO stresses the urgency for the protection of the Human Rights Defenders (HRDs) in Afghanistan as the organization has documented a worrying trend of increasing targeted attacks against the HRDs by Taliban and unknown armed groups across Afghanistan. This is a continuation of a series of violent attacks against human rights defenders including Women Human Rights Defenders, civil society activists and media workers which have been carried out with impunity.

SRMO is calling on Afghan government to do everything to protect Human Rights Defenders and Women Human Rights Defenders in Afghanistan and bring the perpetrators of such crimes to justice.

SRMO is also calling on Taliban to do everything to refrain its fighters from attacking HRDs, WHRDs, CSOs members and media workers in Afghanistan and punish the ones who are deliberately attacking, threatening and killing Afghan civilians including HRDs, WHRDs, CSOs members and media workers.

International and diplomatic community must put pressure on Afghan government to take the protection of Afghan HRDs seriously and bring the perpetrators of crimes against HRDs to justice.

In a previous attack on human rights defenders, Mr. Esmatullah Salam from Ghazni on 1st August, two staff members of the Afghanistan Independent Human Rights Commission (AIHRC) in Kabul on 27 of June 2020;  and on 3rd June 2020 Mr. Ibrahim Ebrat, a local civil society activist was killed in Qalat city of Zabul province. To date no investigation or arrests were made in connection to his killing despite promises by the government to do so.

Afghanistan government must bring to justice perpetrators of the attack on Asmatullah Salaam a Civil Society Activist and Head of Local Council in Andar District of Ghazni Province. 

Safety and Risk Mitigation Organization (SRMO) strongly condemns the killing of Mr Salaam and demand the Afghan government to bring the perpetrators to justice.

According to the report, Mr Salaam was travelling to visit his relatives during the second day of Eid (1st of August 2020) in Khwzeyo village in Andar District of Ghanzni Province, where Taliban stopped his car, kidnapped him and his body was recovered a day later on 2nd August in Wahghez District with severe sings of torture.

SRMO stresses the urgency for the protection of the Human Rights Defenders (HRDs) in Afghanistan as the organization has documented a worrying trend of increasing targeted attacks against the HRDs by Taliban across Afghanistan. This is a continuation of a series of violent attacks against human rights defenders including Women Human Rights Defenders, civil society activists and media workers which have been carried out with impunity. Despite the fact that the Afghanistan government launched the Human Rights Defenders Protection Strategy in January 2020, the government has failed g to investigate such crimes and bring the perpetrators to justice.

These attacks deliberately targeting the HRDs have a chilling effect on the wider community of human rights activists and civil society in Afghanistan who have already reported shrinking of their space to express opinion and hold the powerful to account.

Taliban announced ceasefire during the Eid in Afghanistan but it did not stop conducting deliberate and targeted attacks such as this incident, on Afghan HRDs, CSOs and other civilians.

In the context of the upcoming peace talks between the Afghanistan Government and the Taliban, the role of civil society and HRDs is extremely vital as they bring the voice and speak out in defence of the rights and freedoms of Afghan society and victims, which is important to end the cycle of violence and reach a sustainable peace in Afghanistan. HRDs must never be targeted for simply carrying out their legitimate and peaceful work to promote and protect the human rights of Afghan people. The deliberate attack on HRDs in the context of the armed conflict constitutes a war crime.

Afghanistan government must bring to justice perpetrators of the attack on two AIHRC  staff 

Safety and Risk Mitigation Organization (SRMO) strongly condemns the targeted attack  against two staff members of the Afghanistan Independent Human Rights Commission (AIHRC), which resulted in the killing of Ms Fatima Khalil (24), a Donor Liaison Officer of the  AIHRC and the driver Jawid Folad (41).

The attack happened in the morning of 27 June 2020 in Kabul city’s district 12, while Ms. Khalil and her driver Mr. Folad were on their way to work when their car exploded as a result of a magnetic IED bomb reportedly planted under their car. No group has claimed yet responsibility for the attack. The Afghan government promised an investigation into the incident which was condemned widely by the Afghan civil society and the international

community.

SRMO: Condemns in strongest terms the attack which resulted in death of Mr. Ibranim Ebrat a prominent member of the Afghan civil society in Zabul province.

Safety and Risk Mitigation Organization (SRMO) received reports that Mr. Ibrahim Ebrat one of the prominent members of Afghanistan Civil Society Joint Working Group in Zabul who was shot on 20th May died of his injuries today early morning in Kabul.

Mr. Ebrat who was representing the Afghanistan Civil Society Joint Working Group in Zabul province was attacked by two men riding on a motorbike on 20th May while returning from Ramadan Prayers. He received a bullet to his head and he was transferred to Kandahar and later to Kabul to receive more intensive medical care. He was in critical condition for the past one week where he was kept in life supporting machines but died of his injuries today early morning.

While no group claimed responsibility for the attack, but in the past, Mr. Ebrat reported threats from the Taliban who were asking him to stop his civic activities or face the consequences. Despite a high level of threats, Mr. Ebrat continued his work and didn’t give up on values he truly believed till his last breath.

SRMO has documented an alarming raise in number of targeted attacks against Human Rights and Women Rights Defenders as well as members of the Civil Society including murder, assassination, hostage taking, injuries and serious threats by both state and nonstate actors across Afghanistan. Only in year 2019, four HRDs were killed mostly by the Taliban while tens of others were threatened to death.

Afghan government despite launching a HRD Protection Strategy facilitated by Amnesty International early this year and publicly committing to protect HRDs, have constantly failed to investigate and bring the perpetrators of such crimes against to justice.

The Afghan government must do more to protect Afghan HRDs, WHRDs, CSOs members including media workers. This could be done through investigating attacks against HRDs, WHRDs and CSOs members and bringing the perpetrators to justice and ending the culture of impunity.

Taliban and other Non-State Actors must immediately stop attacks, killing and targeting the members of the Afghan Civil Society, Human Rights and Women Rights Defenders and media workers who do nothing but promote human rights and democratic values. International community particularly USA and EU must put pressure on Taliban to stop attacking the members of civil society, Human Rights and Women Rights Defenders and media workers.

Kabul – Afghanistan: Recover and return safely missing activists Mr. Musa Mahmudi and Mr. Ehsanullah Hamidi

Disappearances from Kabul of two prominent Afghan civil society activists raises high concerns among the already vulnerable human rights community in Afghanistan

Safety and Risk Mitigation Organization (SRMO) calls on the Afghan government to do everything they can to promptly recover Mr. Mahmudi and Mr. Hamidi and return them safely to their families.

SRMO is deeply concerned about the disappearances of Mr. Musa Mahmudi and Mr. Ehsanullah Hamidi – two Human Rights Defenders from Logar and Paktia provinces. Both activists disappeared while traveling for a meeting in Kabul on 21st November 2019.

On Thursday, 21st November 2019, the day they went missing, Mr. Hamidi and Mr Mahmudi were on their way for an official meeting. Mr. Mahmoodi met his colleague Mr. Hamidi near Gulbahar Centre in Kabul and subsequently he called another colleague who was waiting for them outside Jamhoriat hospital and told her that they are on their way. After she waited for them for more than one hour, she tried calling back her colleagues, but their phones were off, and she received no response from either of them

Since Thursday, SRMO and other members of the Human Rights Defenders Protection Committee including Afghanistan Civil Society Forum (ACSF) and Civil Society and Human Rights Network (CSHRN) as well as their families tried to establish contact with them but with no success.

A day before his disappearance, on 20th November Mr. Mahmudi spoke to Horia Mosadiq another prominent HRD from Afghanistan, raising concerns over his safety and said that the National Security Directorate (NDS) is planning to arrest him and he is scared of a conspiracy against him. He didn’t elaborate further on how he knew since he also believed that his phone was under surveillance of the NDS.

Mr. Mahmudi also was subjected to enormous death threats by the public and some local state officials in Logar through Facebook and other online and offline means, after giving media interviews to the UK newspaper, The Guardian, and local news agency TOLO, alleging the presence of a paedophile ring within the education and government offices in Logar province. After the interviews, some members of the Logal provincial council publicly made death threats and incited people against Mr. Mahmudi for “dishonouring the people of Logar”.

“In recent months, the number of attacks against Human Rights Defenders and Civil Society Activists in Afghanistan have increased. These attacks have been carried out with impunity, as the government systematically failed to conduct investigation or bring the perpetrators to justice. This inaction by the authorities is a clear failure of the government to fulfill its human rights obligations and ensure activists can freely carry out their peaceful human rights work.”, said Horia Mosadiq, an Afghan Human Rights Defender.

Human Rights Defenders in Afghanistan are facing enormous pressure and direct threats and attacks in reported higher levels, but the government continues to disregard their safety and protection.

We call on the Afghan government to do everything to find the whereabouts of Mr. Mahmudi and Mr. Hamidi and return them safely to their families.

The Afghan government must take concrete disciplinary steps against the government and elected body officials who publicly threatened Mr. Mahmudi and other human rights defenders. The government also must respond to allegations of the arrest of  Mahmudi and Hamidi by the NDS in connection to his human rights work. This is important to show the Afghan government is fulfilling its obligation to respect and protect the rights of HRDs, freedom of expression and human rights.

The UNAMA Human Rights Unit and other diplomatic missions must put pressure on the Afghan government to take the disappearances of Mr. Mahmudi and Mr. Hamidi seriously and ensure that they are returned safely to their families.

International diplomatic missions and donors must provide technical and financial support towards initiatives for the protection of human rights defenders in Afghanistan. Afghan civil society believes that the protection of HRDs and their freedom to speak freely on issues of human rights, justice and accountability are the only way to preserve the human rights values and gains made in the past decade and to achieve a sustainable peace with respect to the rule of law.

The Afghan government must also investigate the allegations of child abuse in schools and to bring the perpetrators to justice.

Background:

Mr. Mahmudi came into the center of attention after his interview on 13th November 2019, with the UK newspaper, The Guardian, discussing revelations of a paedophile ring in Logar province. He reported that he investigated more than 500 cases from which he documented more than 100 cases of rape and sexual assault against children in four schools and workplaces. He subsequently gave another interview to a local media outlet TOLO TV on the same issue.

After his interviews, Mr. Mahmudi received many death threats from people including some elected local politicians of Logar province through social media and other means. The Afghan government officials including the Ministry of Education rejected his claims and dismissed it as baseless. Subsequently, Mr. Mahmudi and his colleagues had to go into hiding as the government did not only provide any protection for him, but he was reportedly said to be sought by the intelligence service National Security Directorate (NDS).

The disappearances of Mr. Mahmudi and his colleague Mr. Hamidi has raised a lot of concerns for lack of safety and protection of Afghan Human Rights Defenders who operate in increasingly challenging security and political environment. In the last three months (September November 2019) SRMO documented three human rights defenders and civil society activists being killed and one injured.

مفقودالاثر شدن دو فعال مدنی و مدافعین حقوق بشر در کابل نگرانیهای جدی را در میان جامع حقوق بشری آسیب پذیر افغانستان ایجاد گردیده است.

دفتر مصوونیت و کاهش بحران SRMO از دولت افغانستان تقاضا مینماید تا ازهر گونه تلاش برای یافتن عاجل آقای محمودی و احسان الله حمیدی دریغ ننماید و ایشان را به  فا میل های شان بازگردانند.

دفتر مصوونیت و کاهش بحران عمیقا نگران مفقودی آقای موسی محمودی و احسان الله حمیدی – دو تن از فعالین حقوق بشر از ولایات لوگر و پکتیکا هستند میباشد. این دونفر از فعالین حقوق بشر بتاریخ 21 نوامبر 2019 هنگامیکه بخاطر ملاقاتی در سفر بودند مفقودالثرگردیده اند.

بتاریخ 21 نوامبر 2019، روزیکه آقای محمودی و حمیدی مفقودالثر گردید، آنها غرض دیدار با یکی از مقامات رسمی در راه بودند و برای آخرین بار زمانیکه به گلبهار سنتر میرسند با یکی از همکارانشان که نزدیک شفاخانه جمهوریت منتظر آنها بود تماس میگیرند، و میگویند که آنها در راه هستند و همه آنها یکجا  شده به ملاقات خواهند رفت. همکار آنها برای مدت یک ساعت منتظر آنها بود و چندین بار برای آنها زنگ زد ولی آز آنها خبری نشد.

از روز پنجشنبه بدین سودفتر مصوونیت و کاهش بحران (SRMO) و دیگر اعضای کمیته حفاظت از مدافعین حقوق بشر بشمول دفتر مجما و شبکه جامعه مدنی و اعضای فامیل محمودی و حمیدی تلاش میکنند تا با آنها تماس بگیرند ولی تا بحال موفق نشده اند.

یک روز قبل از مفقودی آنها بتاریخ 20 نوامبر 2019، آقای محمودی با یک تن مدافعین حقوق بشر بنام خانم حوریه مصدق صحبت نموده بود و نگرانی های خود را بخاطر امنیت خود اظهار داشته بود، وی گفته بود که امنیت ملی پلان دارد تا علیه وی دسیسه نموده و وی را دستگیر نماید.

آقای محمودی بعد از آن مورد تهدید شدید از طرف مردم و بعضی از مقامات در ولایت لوگر قرار گرفت که در رابطه به یک حلقه بزرگ از افراد که در معارف از اطفال مکتب سوء استفاده جنسی میکردند، به روزنامه گاردین انگلستان و تلویزیون طلوع مصاحبه داد. بعد از این مصاحبه بعضی از اعضای شورای ولایتی لوگر بصورت عام محمودی را تهدید به مرگ کرد و مردم محل را علیه آقای محمودی تحریک نمودند و گفت آقای محمودی ” به مردم لوگر بی عزتی نموده است”.

“در ماه های اخیر حملات علیه مدافعین حقوق بشر و فعالین جامعه مدنی در افغانستان تشدید یافته است. این حملات بدون مجازات صورت میگیرد، و دولت افغانستان بصورت سیتماتیک در تحقیق و کشانیدن مجرمان به محکمه ناکام بوده است. عدم اقدام علیه این حملات نشانگر ناتوانی دولت را در تامین تعهدات حقوق بشری اش میباشد. دولت باید اطمینان دهد که که فعالین بصورت آزاد بتوانند کارهای حقوق بشری و صلح آمیز شان را انجام بدهند. ” این مطلب را خانم حوریه مصدق یکی از مدافعین حقوق بشر اظهار داشت.

باوجودیکه حملات و تهدیدات علیه مدافعین حقوق بشر و فعالین جامعه مدنی بطور بی سابقه تشدید یافته است و این تهدیدات در سطح بالای قرار دارد، دولت افغانستان درقسمت حفاظت وامنیت آنها توجه ننموده است.

ما از دولت افغانستان تقاضا مینمایم که هر گونه اقدام را روی دست گیرند تا محل بودو باش آقای محمودی و همکارش آقای حمیدی پیدا نموده و آنها را بصورت محفوظ به فامیل های شان برگرداند.

دولت افغانستان باید اقدامات جدی و انضباطی را علیه مقامات دولتی و وکلایی که بصورت عام آقای محمودی را و دیگر مدافعین حقوق بشر را تهدید نموده اند، بگیرد. همچنان دولت به اتهامات که اداره امنیت ملی مدافعین حقوق بشر  را دستگیر نموده است رسیده کامل نمایند. و این بسیار مهم است تا دولت افغانستان نشان دهد که آنها تعهدات و وظایف شانرا در قبال احترام و حفاظت از مدافعین حقوق بشر، آزادی بیان و حقوق بشر، انجام میدهند.

دفتر یونیما و بخصوص بخش حقوق بشر و ماموریت های دیپلوماتیک باید بالای دولت افغانستان فشار بیاورند تا در قسمت مفقودالثر شدن آقای محمودی و حمیدی اقدام جدی نمایند، و یقینی سازند تا این دو مدافع نزد فامیل های شان بازگردند.

مراجع دیپلوماتیک و ماموریت های بین المللی و دونر ها باید کمک های مالی و حمایت تکنیکی شانرا بخاطر اقدامات ابتدایی برای حفاظت از مدافعین حقوق بشر در افغانستان، مهیا نمایند. جامعه مدنی افغانستان عقیده دارد که حفاظت از مدافعین حقوق بشر و آزادی بیان در مورد عدالت و پاسخگویی یگانه راه برای نگهداشت از ارزشهای حقوق بشری و دست آوردهای که در ده گذشته بدست امده میباشد. آزادی بیان و پاسخگویی ضامن صلح پایدار و حترام به حاکمیت قانون میباشد.

دولت افغانستان همچنان باید اتهامات سوء استفاده جنسی از اطفال را در تمامی حالات و اماکن مخصوصن مکاتب  افغانستان مورد تحقیق و بررسی قرار دهد و مرتکبین را به محکمه بکشاند.

پس منظر

آقای محمودی پس از آن مورد توجه قرار گرفت که بتاریخ 13 نوامبر 2019، مصاحبه را در مورد استفاده جنسی از اطفال در مکاتب در لوگر مصاحبه را با روزنامه انگلیسی گاردین انجام داد، و از یک حلقه از مرتکبین را افشا نمود. محمودی گزارش داد که وی بتعداد 500 قضیه را تحقیق نموده و بیشتر ار 100 قضیه تجاوز جنسی علیه اطفال را در چهار مکتب و مارکیت سند سازی نموده است. محمودی مصاحبه دیگری را در همین رابطه به تلویزیون داخلی طلوع نیز انجام داد.

بعد از این مصاحبه ها، آقای محمودی از طرف مقامات محلی دولتی در ولایت لوگر تهدید به مرگ شد. مقامات دولت افغانستان بشمول وزارت معارف ادعای آقای محمودی را رد نموده و گفتند که این ادعا ها وافعیت ندارد. سرانجام دولت نه تنها برای آقای محمودی و همکارانش امنیت فراهم نکرد، آنها مجبور شدن تا خود را پنهان نمایند و آقای محمودی گزارش داد که وی تحت تعقیب ریاست امنیت ملی قرار دارد.

مفقودالثر شدن اقای محمودی و همکارش آقای حمیدی نگرانی ها و نبود تحفظ و امنیت را در میان مدافعین حقوق بشر، بخصوص کسانیکه باجود  چالش های امنیتی در مناطق مختلف در افغانستان کار میکنند، ایجاد نموده است. در سه ماه گذشته از سپتمبر تا نوامبر دفتر مصوونیت و کاهش بحران کشته شدن سه مدافعین حقوق بشر و زخمی شدن یکتن مدافع را ثبت نموده است

Attack on Human Right Defenders and Civil Society Activists Must be stopped
Afghanistan: Safety and Risk Mitigation Organization (SRMO) is calling on Afghan government to investigate the assassination of Saeed Karim Muswai in Kunduz province.
Safety and Risk Mitigation Organization (SRMO) is condemning the assassination of Saeed Karim Musawi a Human Rights Defender and civil society activist in Kunduz city city on 23 July 2019.
Saeed Karim Musawi a known Human Rights Defender and CSO activist was shot and killed by two gunmen who were riding on a motorbike and escaped the scene. He was targeted near his home at Kunduz city Khanabad Bandar square when he was heading home and a police investigation is going on. According to civil society activists from Kunduz, the target of intellectuals is becoming more frequent in the province which is scaring everyone who is critical of the current security and political situation in the province. No one claimed responsibility for the attack so far.
Kunduz is one of the insecure provinces in the North of Afghanistan where Taliban managed to take over the city twice between 2015-2016 and Taliban continue to make advances in the province.
SRMO is calling on the Afghan government to do investigate the assassination of Mr. Musawi and other intellectuals in the province, bring the perpetrators to justice and use all its resources to ensure the safety and security of Human Rights including Women Rights Defenders, civil society activists and journalists in Afghanistan.
Meanwhile, the Afghan Civil Society Joined working group in a statement condemned the killing and said this attack indicates that terrorists and Afghanistan enemy has no respect for human rights, Islamic values and freedom of expression, and their main goal is the killing of innocent and impartial individuals of the society. The group emphasizes that according the Islamic and international humanitarian laws, the civil society activists and civilians should not be targeted.
